I never joined a political party, and came to view political parties as cults, religions. Over the years, discussing Donald Trump with Republicans on Facebook was like discussing Jesus in the Gospels with Christians. Talking with Democrats on Facebook was like talking with members of the mythical Fukawi tribe, which always was getting lost and gathering in a circle and sitting down and holding hands and closing their eyes and chanting, "Where the fuck are we? Where the fuck are we?"
I saw in news reports that Trump said, if he is reelected, he will pardon all people who participated in the January 6, 2021 assault on the US Capitol, which he has the power to do, if he is president. The thought came to me yesterday, that President Biden can use that same power to offer pardons to the same people, if they go before a notary public and are sworn in and sign a document in which they they swear before God, under penalty of perjury, that they will testify in court that they acted solely on President Trump's orders to assault the national Capitol on January 6, 2021, and if they don't so testify in court, they don't get pardoned by President Biden. Armed with such sworn documents, President Biden's Attorney General prosecutes Donald Trump in the United States District Court of Washington, D.C., for inciting insurrection against the United States of America, and for breaching his sworn oath to defend its Constitution."I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
That post garnered a response from someone living in Dallas, Texas, whose friend request I had accepted, because his Facebook profile showed he was from Birmingham, Alabama and, like me, he had attended the McCallie School in Chattanooga, Tennessee, and Vanderbilt University in Nashville, Tennessee. In prior Facebook discussions, he had impressed me that Charles Darwin got evolution totally backward. Humans devolved from apes. He did not change my mind this time.

According a Harvard Law Review from 2021 the subject of Presidential pardons covered a topic is his power to pardon unfettered. And the writer said no because if this were an unfettered, a President could pardon convicts, grant them the right to vote, provided they voted for him, and if they didn't, throw them back in jail. That seems to me a fatal blow to your idea about Biden pardoning January 6th insurrectionists.
It's your buddy Donald Trump, who said, if he gets elected president again, he will pardon the Jan 6, 2021 insurrectionists, who were tried and convicted, or were not yet tried and convicted. So, this lawyer figured Trump got a legal opinion that he could do it, and I'm pretty sure he can do it, but, since Joe Biden's a Democrat President, he cannot promise to pardon as yet not convicted Jan 6, 2021 insurrectionists, IF they sign the affidavit under oath as I described in my post today, and IF they then do testify in court against Trump as being the sole reason they tried to take over the national Capitol and stop the Congress from certifying Joe Biden was elected? What's sauce for the goose isn't sauce for the gander? As for the Law Review article you say was written, it is not binding on any court, and it really has zero do with what Trump promised he will do, if he becomes president again, and with what I suggested Biden can do, if he has any sense and balls.JosephYour original reference was to Trump says he would pardon if elected but that's not certain and if he was, and did pardon I believe those pardoned have already been convicted and have lost the right to vote so would not have voted in the 2024 election. In my Christian religious view the act of pardoning mimics the type of pardon bestowed on people by God. Underserved and by grace.
Sloan BashinskyI don't get why you dragged in getting to vote again. Trump made it plain to his base, including you, that if he is reelected president in 2024, he will pardon the people who stormed and invaded the national Capitol on January 6, 2021. I am quite sure he can do it. It has nothing to do with God, or with grace, but with his own ego and knowing the promise of doing it will get him lots of attaboys on social media and in the conservative press and at the ballot box. Trump's own Attorney General William Bar said Trump's stolen election claims were "bullshit." You remind me of lots of ministers I have known, who can't imagine the Devil's favorite place to hide, so no one will think to look for him, is in a church. In any event, Biden is an idiot if he doesn't take Trump's cue, and offer Trump's lemmings pardons now, instead of being prosecuted, if they will rat out Trump in court.JosephBefore you continue this line of viewpoint, consider this the Federal prosecutors have probably proffered every deal they can with these unfortunate people. Two years without trial or indictments and inability to be properly defended by a defense attorney. And given the example of the buffalo head navy veteran exculpatory evidence has probably been hidden from other defence attorneys too. I think that the weight of legal malfeasance being done by our Federal processes in this insurrection aftermath while at the same time hiding the salami so to speak of Hunter Biden 's laptop is like the legalisms of a third world dictatorship and far worse than the actual criminal trespass at the Capitol.
Sloan BashinskyI’m all for a prosecutor stripping Hunter naked, and prosecuting him for every crime he actually committed. But Trump‘s AG Bill Barr didn’t do it.JosephThat proves that the Justice Department and the FBI need a thorough housecleaning. I watched a Heritage Foundation panel discussion a couple of days ago discussing this. Molly Hemenway says lawyers at Justice routinely block or refuse to prosecute or support lawful initiatives from their ultimate boss the President, who is the CEO of all agencies and departments of the government. Not to mention the refusal or intransigent stone walling of releasing documents to Legislative committees charged with oversight. It's absolutely disgusting to listen to these bureaucrats hem haw or lie when questioned.
Sloan BashinskyTrump was President, he was Barr and the Justice Department’s boss. So, you just convicted your beloved Trump, who didn’t do shit to get Hunter gotten after. However, as you did in past discussions, you threw up a lot of red herrings to dodge what I posted - in this case, Biden trumping Trump with his own pardon power game.JosephI didn't dodge the pardon issue. I believe my counter argument specifically said or emphasized that Trump's promise of pardon's unfettered meaning is it requires nothing to be done by those pardoned. Your suggestion that Biden ought to promise to pardon participants of January 6 if they vote for him in 2024 is a conditional pardon fettered. You tried to blow me off when I referred you to the Harvard Law Review about Presidential pardons. ( Since you went to law school). This isn't a red herring at all. Your idea about what Biden ought to do though novel probably doesn't hold legal water!)
Sloan BashinskyAre you daft? Mentally impaired? So blinded by your love for Trump that you cannot read plain English? I did not suggest Biden offer to pardon anyone if they vote for him. But that is what Trump offered the Jan 6 insurrectionists, IF they and other people vote him back into the White House in 2024.JosephI suggest you review Wilson v. United States , Burdick vUnited States, and revoked pardons in Andrew Johnson's time and George Herbert Walker Bush's time, as well as the DOJ'S standards of clemency. I think your suggestion on what Biden should do legally may not be feasible.Sloan Bashinsky
I suggest you learn to read plain English before speaking. Your Lord and Master Donald Trump is who promised to pardon the Jan 6 terrorists, if he gets back in the White House.
Joseph
So what? It's Cinco de Mayo, kick your heels up and have some fun. Adios
Sloan BashinskyBut Trump getting elected and pardoning the Jan 6 terrorists is feasible. I keep wondering if the McCallie Calvinists poisoned your brain and your soul?
